Operator: Daylyf Ltd Registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom Company number: 17374540 (registered in England and Wales) ICO registration number: ZC210969 Contact: support@daylyf.com
1. About Daylyf
Daylyf operates a marketplace where verified guests can book private homes and spaces by the hour for daytime use only. Daylyf is not a hotel, not a short-let operator, and not a place to spend the night. We provide the platform and trust layer; the host provides the space.
By creating a Daylyf account or using the Daylyf app you agree to these Terms of Service ("Terms"). If you do not agree, do not create an account or make a booking.
These Terms form a legally binding contract between you and Daylyf Ltd, a company registered in England and Wales (company number 17374540; registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom). Daylyf Ltd is registered with the Information Commissioner's Office under registration number ZC210969. These Terms are governed by the laws of England and Wales.
2. Platform role and the host–guest contract
Daylyf Ltd operates an online marketplace and booking platform only. Daylyf does not own, lease, manage, operate, furnish, or control any property listed on the app, and does not provide accommodation or hospitality services. Each listing is offered by an independent host who alone decides whether to accept bookings, sets house rules, and is responsible for the physical space.
When you confirm a booking, you enter a direct contract for the use of space with the host for the booked date and hours. Daylyf is not a party to that use-of-space contract. Daylyf provides technology (search, messaging, identity checks, and payments processing via Stripe) and trust tools; the host provides the space and on-site experience.
Daylyf may act as a limited payment collection agent for the host: guest payments processed through Stripe are applied to the booking on the host's behalf, subject to these Terms and the Host Agreement. That agency is for payment only and does not make Daylyf the host, landlord, property manager, insurer, or guarantor of the listing.
No safety or quality warranty. Daylyf does not guarantee that any listing is safe, lawful, suitable for your purpose, or as described. Hosts—not Daylyf—are responsible for statutory health and safety compliance, insurance, and the condition of their properties (see the Host Agreement). Daylyf may require hosts to upload safety evidence and may suspend listings, but review or approval of documents does not mean Daylyf certifies the property is safe.
User-generated content. Listing descriptions, photos, reviews, and messages are provided by users. Daylyf may remove or restrict content that breaches these Terms but does not independently verify every statement.
3. Eligibility
To use Daylyf you must:
- Be at least 18 years old.
- Have full legal capacity to enter contracts.
- Provide accurate, current, and complete information.
- Complete identity verification before making a booking: Verified ID (through Didit ID + liveness) and Verified Email. Daylyf calls this the Booking Access Gate. Daylyf does not use Stripe Identity for this Tier 1 check. Phone verification is offered for account security and host↔guest communication but is not currently required to make a booking.
We may refuse, suspend, or terminate your account at any time if any of these conditions is not met or stops being true.
4. Your account
You are responsible for:
- Keeping your sign-in credentials secret.
- All activity under your account.
- Notifying us immediately at support@daylyf.com if you suspect unauthorised access.
We use Cloudflare Turnstile and per-account lockouts to defend against unauthorised sign-in attempts. Repeated failed sign-ins will temporarily lock your account.
You may operate Daylyf in Guest Mode or Host Mode. Switching to Host Mode requires additional KYC and host onboarding (see the separate Host Agreement).
5. Bookings
5.1 What you're booking
A "Daycation" is a scheduled, daytime-only use of a host's space for the specific arrival and departure hours you select at booking. Overnight stays are strictly prohibited and constitute a material breach of these Terms.
When you book, you select:
- A date,
- An arrival hour (within the host's check-in window),
- A departure hour (within the host's check-out window),
- The number of adults and children in your party,
- The number and type of pets if the listing is pet-friendly,
- Vehicle registration if you bring a car to a parking-equipped listing.
Total party size (adults + children) must not exceed the host's listing capacity. Daylyf enforces a maximum of 2 pets per booking on pet-friendly listings.
5.2 Pricing
The total price displayed before you confirm is the price you pay. Prices are set by the host using the Daylyf pricing matrix (Base + Tier 1–3 + Max windows). Daylyf charges hosts a 13% platform fee on each booking. There are no booking fees added on top of the listed price for guests at this time.
All prices are in Pounds Sterling (£) unless stated otherwise.
5.3 Confirmation
A booking is confirmed when:
- You have completed payment through Stripe (card or other Stripe-supported methods shown at checkout), and
- The booking status moves from pending payment to confirmed.
You will receive an in-app confirmation, an automatic check-in instructions message from the host (or auto-shipped self check-in instructions if the host opted in), and an email receipt.
Payment is processed by Stripe. Daylyf does not store your full card number. Hosts receive eligible earnings through Stripe Connect Express after any applicable payout hold (see the Host Agreement).
5.4 The "No Noise" policy
Daylyf strictly enforces a No Noise policy at every listing. You agree that:
- You will not host parties, gatherings, or events generating noise that could disturb neighbours.
- You will follow all house rules set by the host.
- A reported noise breach may result in immediate cancellation, forfeit of payment, and a permanent ban from Daylyf.
5.5 Cancellation & refunds
Guest cancellations for upcoming bookings are handled in the Daylyf app (My Bookings). Before you confirm a cancel, the app shows any refund amount that applies under this policy.
Guest cancel (self-serve), measured from the booking check-in time:
- 48+ hours before check-in: full refund of the amount paid.
- 24–48 hours before check-in: 50% refund.
- Less than 24 hours before check-in: no refund.
- Once check-in time has passed (or the stay has started): self-serve cancel is not available. Contact support@daylyf.com.
Unpaid bookings (awaiting host approval or awaiting payment) can be cancelled in-app with no charge.
Paid refunds are issued by Stripe to your original payment method (typically 5–10 business days, subject to your bank). Daylyf does not issue wallet balances or bank transfers for ordinary guest refunds.
Host cancellations of a confirmed or paid booking are not completed by hosts in-app. The host must contact support@daylyf.com. Daylyf will cancel the booking and, where the guest has paid, issue a full refund to the guest's original payment method. Daylyf may charge the host a cancellation fee deducted from a future payout. Repeated host cancellations may result in delisting.
Access failures, listings not as described, fraud, and other exceptions are handled by support@daylyf.com and may result in a full or partial refund at Daylyf's reasonable discretion under these Terms.
5.6 Active Stay and arrival photos (recommended)
During your booked hours you may open Active Stay in the app for access notes, Wi‑Fi, and emergency help. Active Stay is recommended so stay details are easy to find, but it is not mandatory — there is no required "tap to check in" step to keep your booking valid.
Arrival photos (sometimes shown as check-in photos) are also optional but recommended. If you choose to capture them, Daylyf uses the in-app camera only (gallery uploads are blocked) and applies a visible watermark (your booking code, the capture time, and coordinates) plus a SHA-256 integrity hash and coarse geolocation, which Daylyf independently re-verifies server-side, to help protect you and the host if a dispute arises. By capturing photos you consent to that processing. Skipping photos does not cancel or invalidate your booking.
6. Host listings (when you're a guest)
Listings are created by independent hosts (see §2 — Platform role). Daylyf:
- Requires host identity verification (Didit) and lawful-right evidence (owner title, or lease + landlord permission, or agent authority), and Stripe Connect Express onboarding for payouts.
- Reviews listing photos for "live capture" provenance.
- Enforces the No Noise policy.
But Daylyf:
- Does not physically inspect every listing.
- Does not guarantee that every detail in a listing description is accurate.
- Is not the host of the listing and is not a party to the direct use-of-space contract between you and the host.
You agree that any dispute over the condition, safety, or suitability of a listing is primarily between you and the host. Daylyf will mediate in good faith for platform purposes (refunds, suspensions, account actions) but does not assume the host's legal duties.
7. Acceptable use
You will not:
- Use Daylyf to do anything illegal.
- Stay overnight at any listing.
- Sublet, advertise, or resell access to a booked space.
- Hold a party, event, or commercial gathering without explicit prior host approval and listing-permitted use.
- Post abusive, threatening, fraudulent, or sexually explicit content in messages or reviews.
- Attempt to circumvent the Booking Access Gate or any other security control.
- Scrape, copy, or reverse engineer the app or the API.
- Bring more guests, children, or pets than the booking allows.
We reserve the right to remove content, suspend your account, void bookings, retain payments, and report you to law enforcement for any breach.
8. Reviews and decentralised safety signals
If you submit a review or listing report, you grant Daylyf a worldwide, royalty-free licence to display, analyse (including automated checks for safety-related terms), edit (for length / clarity), and remove that content. Reviews and reports must be honest, factual, and free from threats or hate speech.
Automated safety enforcement. Daylyf may automatically suspend a listing pending staff review when guest feedback or reports indicate a potential safety hazard (for example gas, fire, electrical faults, water quality, blocked escape routes, or similar). Suspended listings are taken offline until the host provides satisfactory evidence and Daylyf completes its review. This decentralised enforcement supplements — and does not replace — host self-certification and Daylyf's certificate review process.
9. Intellectual property
The Daylyf brand, app, software, design system, and all related materials are owned by Daylyf Ltd. You may use them only as needed to use the service. You retain ownership of content you upload (your listing photos, your messages, your reviews) but grant Daylyf a worldwide, royalty-free, sub-licensable licence to host, display, and use that content for the purpose of operating Daylyf.
10. Liability
To the maximum extent permitted by law:
- Daylyf provides the platform "as is" and "as available".
- Daylyf does not warrant that the app will be uninterrupted, error-free, or free from harmful components.
- Daylyf's total liability to you for any claim arising out of or relating to your use of Daylyf is capped at the greater of (a) the total fees Daylyf received from you in the 12 months preceding the claim, or (b) £100.
- Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law.
- Daylyf is not liable for the acts, omissions, property condition, or statutory compliance of any host or guest.
11. Indemnity
You agree to indemnify and hold Daylyf, its directors, employees, and contractors harmless from any claim, demand, or loss (including reasonable legal fees) arising out of:
- Your breach of these Terms,
- Your use of any listing or your direct dealings with a host or guest,
- Your content (messages, reviews, photos),
- Your violation of any law or third-party right.
12. Termination
You may stop using Daylyf at any time and delete your account in Profile → Legal & Account → Delete my account or by emailing privacy@daylyf.com.
We may suspend or terminate your account if you breach these Terms, fail KYC, are reported for safety reasons, or where required by law. We will tell you why unless prevented by law or a credible safety reason.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app and by email at least 14 days before they take effect. Continuing to use Daylyf after a change means you accept the updated Terms.
14. Disputes & governing law
These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
We strongly encourage you to email support@daylyf.com before starting any formal proceedings — most disputes can be resolved quickly that way.
